Proposal: Expansion of an existing UPS facility by adding 30 new dock doors to the north side of the existing building and expanding the paved area to the north to allow room for semi-truck trailer parking. Expansion to the north would include filling a portion of a Category II depressional wetland located on the adjacent property to the north; off-site wetland and stream restoration and creation will be done to offset these impacts.

Statement of Consistency and List of Applicable Development Regulations: This proposal is subject to and shall be consistent with the Auburn City Code, Comprehensive Plan, and Public Works Design and Construction Standards.
Lead Agency: The Responsible Official of the City of Auburn, the lead agency, hereby makes the following Findings of Fact based upon impacts identified in the SEPA Checklist and the associated studies and documents submitted by the Applicant, and Conclusions of Law, based upon the Auburn Comprehensive Plan, and other Municipal policies, plans, rules and regulations designated as a basis for the exercise of substantive authority under the Washington State Environmental Policy Act Rules pursuant to RCW 43.21C.060.
Conclusions of Law: Staff has concluded that a MDNS is appropriate to be issued. This is based upon the SEPA checklist and it’s attachments. This MDNS is supported by plans and regulations formally adopted by the City for the exercise of substantive authority under SEPA. The MDNS also takes note of the extent to which many local, State and Federal regulations and permit requirements will govern the project to mitigate its potential impacts, in accordance with WAC 197-11-158 and RCW 43.21C.240. Chapter 16.10 ACC provides the City’s regulations and authority for modifications to critical areas and offsetting mitigation requirements.
Conditions: The Responsible Official has determined that the proposal does not have a probable significant impact on the environment that is not able to be mitigated using existing adopted regulations, and an Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c), only if the following condition is met. This decision was made after review of a completed environmental checklist, other information on file with the City of Auburn, and existing regulations. This information is available to the public on request. This mitigation measure is required as authorized under the Substantive Authority of SEPA in accordance with the guidelines contained in Ch. 16.06 ACC and shall be implemented by the Applicant:
1. The Applicant shall complete the off-site mitigation measures, as outlined in the Conceptual Mitigation Plan, prepared by Soundview Consultants, dated December 2021. The mitigation shall be completed prior to, or concurrently with, the wetland fill.
This MDNS is issued under WAC 197-11-350; the lead agency will not act on this proposal for 15 days from the date of issuance. Comments must be submitted by 5:00 PM on January 19, 2022. Any person aggrieved of the City's determination may file an appeal with the City Clerk’s office within 21 days ending 5:00 PM on February 8, 2022.
